1. The agreement
The My Pet Memoir website and services are provided by TIN MAN GROUP LIMITED (company number 12716894) (“we”, “us”).
These terms form a binding agreement between you and TIN MAN GROUP LIMITED. If you use My Pet Memoir on behalf of an organisation (for example a veterinary practice), you confirm you have authority to bind that organisation.
2. The service
My Pet Memoir provides tools to create, publish, and maintain digital memorials, including optional moderation, media storage, and related features. The service is provided on a best efforts basis. We do not commit that the service will be available at any particular time, for any particular duration, or without interruption. We may modify, suspend, or discontinue features where necessary for security, legal compliance, or operational reasons, and will give reasonable notice when practicable.
3. Accounts and access
You are responsible for safeguarding access to your account and for activity that occurs under it. You must provide accurate registration information and keep memorial access permissions appropriate for your situation (for example when handing a memorial to family members).
4. Acceptable use
You agree not to:
- upload or solicit content that is unlawful, harassing, defamatory, discriminatory, exploitative, or invasive of others’ privacy or dignity;
- attempt to disrupt, probe, or gain unauthorised access to our systems or other users’ data;
- use the service to send spam, malware, or misleading communications;
- scrape or harvest data at scale without our written consent, or use the service in breach of applicable law.
We may remove content, suspend accounts, or take other action where we reasonably believe these rules or the spirit of the service are at risk.
5. Memorial content and rights
You retain rights in content you submit, subject to licences and permissions needed for us to host, display, back up, moderate, and improve the service (for example formatting, resizing images, or generating previews). You confirm you have the rights and, where needed, consents to share content about third parties (including people who have died) in line with law and respect for bereavement. You are responsible for the accuracy and lawfulness of memorial content.
6. Fair use and memorial storage
You may upload content to a memorial only within our fair use policy: use should stay within ordinary personal or professional memorial purposes and reasonable volumes so that performance, security, and costs remain sustainable for everyone usingMy Pet Memoir.
To protect that balance and help ensure a reliable, high-quality experience for all users, we may review storage and usage associated with a memorial (for example total data volume, types of files, or patterns of upload or traffic), including to check compliance with these terms and this fair use policy. If use falls outside fair use, we may contact you, ask you to reduce or remove content, apply technical limits, or take other steps described in these terms.
7. Partners
Veterinary, pet crematorium, shelter, and similar partners may use dedicated workflows to create or assist with memorials. Partners must use My Pet Memoirconsistently with these terms, their professional duties, and any separate commercial arrangements with us or families.
8. Fees and payments
Certain features require a one-time payment processed by our payment provider. Prices and taxes are shown before you confirm purchase. Payments are subject to the provider’s terms. Unless required by law or expressly stated at purchase, fees are non-refundable once digital fulfilment has begun.
9. Disclaimers
The service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that the service will meet every expectation or be error-free. To the fullest extent permitted by law, we make no commitment to cover or make good any financial loss, cost, or hardship arising from your use of, reliance on, or inability to use the service, except where the law requires otherwise. Nothing in these terms excludes or limits liability that cannot be excluded or limited under UK law.
Artificial intelligence and other automated or assistive technologies may be used in developing My Pet Memoir and in producing or processing content available through the service. Such technologies can produce inaccuracies, omissions, or other unintended results. To the fullest extent permitted by law, we are not liable for errors, omissions, or other issues arising from the use of those technologies in the app or in memorial or other content.
10. Limitation of liability
Subject to the previous section, our total liability arising out of or relating to these terms or the service is limited to the greater of (a) amounts you paid to us for the memorial or feature giving rise to the claim in the twelve months before the event, or (b) one hundred pounds sterling (£100), except for matters where the law does not allow a cap. We are not liable for indirect or consequential loss, loss of profits, or loss of data except where such exclusion is unlawful.
11. Suspension and termination
You may stop using My Pet Memoir at any time. We may suspend or terminate access for breach of these terms, risk to others, or legal requirement. Provisions that by their nature should survive (including intellectual property, liability limits where permitted, and governing law) will continue.
12. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to mandatory protections for consumers where applicable.
